What is Military Parole in Place?
Normally, if a foreign national enters the United States without inspection (undocumented entry) and later marries a U.S. citizen or has an adult U.S. citizen child, they cannot apply for a Green Card from inside the U.S. Instead, they must leave the country for “consular processing,” which can trigger automatic 3-year or 10-year bars on reentry and cause painful family separation.
Military Parole in Place (PIP) is a specialized, discretionary benefit granted by USCIS that eliminates this obstacle for military families. It grants the individual temporary lawful status right here in the U.S., allowing them to bypass the risky consular process.
An approved Military PIP provides:
- Protection from Deportation: Grants temporary lawful presence in the U.S. (typically in one-year increments).
- Work Authorization: Eligibility to apply for an Employment Authorization Document (EAD).
- The “Legal Entry” Bridge: Satisfies the lawful entry requirement needed to apply for a Green Card via Adjustment of Status from inside the United States.
Who is Eligible for Military PIP?
To qualify, the applicant must have a qualifying family relationship with an eligible U.S. military sponsor.
1. Eligible Military Sponsors
The sponsor must be a U.S. citizen or Lawful Permanent Resident who is:
- An active-duty member of the U.S. Armed Forces;
- A member of the Selected Reserve of the Ready Reserve (including the National Guard); or
- A military veteran who served honorably and was not dishonorably discharged (living or deceased).
2. Qualifying Family Relationships
The foreign national applying for PIP must be the military sponsor’s:
- Spouse or widow/widower
- Parent
- Son or daughter (of any age or marital status)
Important Note: Because Military PIP is fully discretionary, USCIS reviews each application on a case-by-case basis. They weigh positive humanitarian factors and the service member’s military contributions against any negative factors, such as a criminal record.
